Client shall pay a non-refundable 50% retainer and the remaining balance on the day of session. This fee secures your session booking and current pricing structure. This retainer also serves as a cancellation fee to protect from no shows and last minute cancellations. Retainer is deducted from session, and can be credited towards one future session as long as it's rescheduled within 72 hours prior to your shoot. All remaining balances are due at the time of the session, and will receive no images until paid in full.
The Session date WILL NOT be reserved until after the first payment is received.
Total session time includes any prep client may need to do any background staging, hair, makeup, and outfit changes. Late arrivals will result in shorter sessions. More time can be added for extra backdrops , multiple concepts, and or locations, but it is not guaranteed day of. It is recommended to schedule extra time prior to insure no conflicts in scheduling.
Sessions with multiple locations, and areas outside of Colorado Springs Limits need to be addressed to photographer prior too booking, as travel expenses, and or additional time may be required.
Once photos have been taken, proofs will be sent via email within 3 business days of session. Once favorites have been chosen, finished edits will be sent via email within 3 weeks of favorites selection date.

TERMS & CONDITIONS
ADULT PARTICIPATION: If the subject photographed is under the age of eighteen, then a parent and/or legal guardian defined as an individual of eighteen years or older acting with legal rights over the minor, shall be the point of all communications and shall attend all sessions.
SERVICES: Photographer will be ready at location or have studio set up and ready at agreed upon start time. Client must specify of any location, backdrop color(s), concept, and mood boards changes at least 24 hours before session . Client will have access to chairs, stools, sunglasses, and amazing lighting, posing help, and high quality images to choose from.
(*balloons, cake, wardrobe, shoes, accessories, and other special props etc. are NOT INCLUDED but you are more than welcome to bring items to make your shoot unique to you.)
COMPLETION SCHEDULE: Once photos have been taken, proofs will be sent via email within 3 business days of session. Once favorites have been chosen, finished edits will be sent via email within 3 weeks of favorites selection date. Raw/Original Images are not included but entire unedited session can be purchased separately. Your gallery will remain online for (4) weeks. If your gallery expires prior to you downloading, you may request a gallery reload at a rate of $25.
DEADLINES: The client shall be solely responsible for informing Photographer of any deadlines related to the session in writing. (example yearbook, birthday, etc.) Deadlines must be approved by photographer, and be made before booking if possible. Photographer will make reasonable efforts to comply with the deadline requests but additional fees may be required. The photographer shall not be held responsible if client fails to provide favorite selections, in a timely manor. Photographer will not start on any rushed edits until full payment is received.

SESSION RULES & LATE POLICY
-Please be on time, and arrive no more than 15 min early
-Session will start at your scheduled time. If you are late, your session will still end at scheduled time.
-If you are 30 minutes late, and no effort has been made to contact photographer your session will be automatically canceled. Your retainer will act as your cancellation fee, and a new retainer will be required to book in the future.
-If session goes beyond your scheduled time, you will be charged by each 1/2 hour. ($50)
-No kids allowed in studio unless they are part of the shoot or approved by photographer ahead of time, and must be accompanied at all times.
-No smoking in the studio
-No colored turmeric powder for sessions in studio
-No other forms of photography or videography during the session without the express written permission of the photographer.
-Client will pay additional retouching fees for poor wig installs. Your lace must be good quality, and blended correctly or you will be charged extra or left as is. (Up to $10/Image depending on severity) I strongly recommend hiring professional hair and make up services to ensure the best photos, and confidence for your session. Photoshop can only do so much.
-Client is responsible for any studio damages caused by any member of clients party and subject to damage fees, and will not receive any images until paid. Any damage done to paper backdrops such as ripping or excessive stains, dirt etc. will result in a charge of $5 per foot.
VENUE AND LOCATION LIMITATIONS: The Photographer is limited by the rules and guidelines of the location(s) and site management. The Client agrees to follow all rules and guidelines of location.
PERMITS: The Client is responsible for contacting and paying admission costs, permits as well as acquiring necessary permission for all locations on which the Photographer will be performing services.
RESCHEDULING: Should the client need to reschedule, a 72 hours notice is required. Client is allowed one event of rescheduling, but please give as much notice as possible. Please do not reschedule for minor skin injuries or blemishes. If the weather is torrential and we cannot shoot, the session will be rescheduled or shot in studio. Clouds, light wind, light sprinkles aren't a problem and I usually go ahead with the session.
CANCELLATION POLICY: For all sessions, client forfeits their session retainer paid to book the session. The fee can be credited towards a future session if the client reschedules the appointment by contacting photographer at least 72 hours prior to the date of session and re-booking at an agreeable date and time. If no reasonable notice is given, or you do not show up for your session, you forfeit your retainer fee and another will be required to reschedule. Retainer fees are non-refundable but may be used toward a rescheduled session in the event of an emergency with 72 hours notice.
FAILURE TO PERFORM: In the unlikely event that the photographer is unable to take pictures at the reserved date, Photographer will make every effort to secure a replacement photographer. However if photographer cannot perform this booking due to fire.casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return the retainer fee to the Client but shall have no further liability with respect to the booking. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or other media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer.
INDEMNIFICATION -The Photographer shall not be held harmless for any and all injury to client during the course of the photography session and the immediately surrounding events.
COPYRIGHT: All photographs and footage are and shall remain the sole intellectual property of the photographer per the United States Copyright Laws. The Client hereby waives any rights to intellectual property ownership, monetization, or reproduction of the images and footage created by the Photographer, with exception of the terms of any formal written releases provided to the Client by the Photographer.
IMAGE PROCESSING, RETOUCHING, AND EDITS
The Client selects the images that the Photographer will edit. Any additional edits beyond what was included in the original photo package, must be purchased before photographer will start editing. Photographer will only deliver high-resolution, edited JPEG images to Client and will not send unedited original "RAW" files to Client under any circumstance unless purchased separately. Photographer spends 2-3+ hours on each image making sure Clients selected favorites are edited to the highest perfection. Photographer professionally edits and retouches face, body, background, contrast, lighting, color, distracting objects, and cropping. Composite/Collage Images are an additional cost. CLIENT USAGE: The images that are provided to client are licensed to client including but not limited to: printing, yearbook, copying, e-mailing, and web publishing. You may not edit, alter, or change these images in any way without express written permission of photographer. This includes but is not limited to photo editing software and applications such as Instagram, Snapchat, and Facebook. Clients license does not include any use that results in financial gain of the images, including but not limited to stock photography, NFT's, apparel, merchandise, print sale profits, or resale of any nature. The Client may present this contract to photo printing companies if they request authorization from the Photographer.
SOCIAL MEDIA: The Client may share final edited images. When uploading to Facebook, Instagram, and other Social Media outlets, the Client shall “tag” credit the Photographers business page. Do not alter image by changing color, retouching, or adding a filter/preset. If you would like something edited further, please reach out to photographer.
MODEL RELEASE: The Client hereby assigns the photographer, legal representatives, and assigns the irrevocable, perpetual, and unrestricted right to take and use photographs of me taken by the Photographer (“Photographs”) in all forms, media and manners, in conjunction with my own or a fictitious name, for advertising, trade, promotion, exhibition, or any other lawful purposes. I now and in the future waive any right to review or approve: the Photographs themselves, the use of the Photographs, or the matter that may be used in conjunction with the Photographs, regardless of whether the use or matter is known to me. I waive any right to royalties or other compensation arising from or related to the use of the Photographs. I release, discharge, and agree to hold harmless Photographer and Photographer's heirs, legal representatives, and assigns from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking, processing, or publication of the Photographs.
MINOR MODEL RELEASE:
The Client being the parent or guardian of the minor being photographed and has the legal authority to execute this release on behalf of the Minor. In consideration of the Minor’s engagement as a model and for other valuable consideration acknowledged as received, I give Photographer's, and assigns the irrevocable, perpetual, and unrestricted right to use photographs of the Minor taken by the Photographer (“Photographs”) in all forms, media and manners, in conjunction with the Minor’s or a fictitious name, for advertising, trade, promotion, exhibition, or any other lawful purposes. I now and in the future waive any right to review or approve: the Photographs themselves, the use of the Photographs, or the matter that may be used in conjunction with the Photographs, regardless of whether the use or matter is known to me. I waive any right to royalties or other compensation arising from or related to the use of the Photographs. I release, discharge, and agree to hold harmless Photographer and Photographer's heirs, legal representatives, and assigns from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking, processing, or publication of the Photographs.
ARCHIVE OF PHOTOGRAPHS: Photographer will retain copies of the photographs taken pursuant to this Agreement for at least 12 months after the portrait session.
